SCRAN REFUND, CANCELLATION AND NFC COLLECTION POLICY

This Policy applies to subscriptions, physical NFC products and related services supplied by:

1. Standard subscription

Unless another price has been agreed in writing, the standard Scran subscription costs:

$15 AUD per week for one business venue.

The subscription:

a. is billed weekly in advance;

b. renews automatically;

c. continues until cancelled; and

d. includes the services identified at checkout or in the applicable order confirmation.

2. How to cancel

You may cancel your subscription at any time by:

a. using the Stripe customer portal, where available; or

b. emailing team@scran.com.au.

Your request should include:

a. business name;

b. venue name;

c. subscribed email address;

d. contact telephone number, where relevant; and

e. whether you are claiming the 30-day guarantee.

3. Effective date of cancellation

Unless otherwise agreed, cancellation takes effect at the end of the current paid weekly billing period.

No further weekly subscription payment will be charged after cancellation becomes effective.

You may request immediate termination, but an unused portion of a weekly period that has already begun is not ordinarily refundable solely because you request immediate cancellation.

This does not affect:

a. the 30-day promotional guarantee;

b. remedies for faulty goods or deficient services; or

c. any non-excludable rights under the Australian Consumer Law.

4. Thirty-day promotional guarantee

A new subscribing venue may request a refund under Scran’s 30-day promotional money-back guarantee within 30 calendar days after its first successful subscription payment.

The request must be received by email at:

team@scran.com.au

before the end of the 30-day period.

5. Eligibility

Unless otherwise required by law, the promotional guarantee:

a. applies once per venue;

b. applies once per business and controlling owner;

c. does not restart if a customer cancels and later resubscribes;

d. applies to standard subscription fees paid during the first 30 calendar days;

e. does not apply to separately quoted bespoke work unless agreed in writing; and

f. is additional to statutory consumer rights.

6. Full-refund option

You may receive a refund equal to 100% of the standard subscription fees paid during the first 30 days if:

a. you cancel within the guarantee period;

b. you notify Scran that you choose the full-refund option;

c. you make all supplied NFC cards, plaques and other physical NFC products available for collection by Scran;

d. you cooperate reasonably to arrange an agreed collection date, approximate time and location;

e. you keep the products reasonably safe until collection; and

f. Scran successfully collects all supplied products.

You are not required to post or personally return the products to Scran.

Scran will arrange and bear the reasonable cost of collection.

7. Collection arrangements

After receiving a valid full-refund request, Scran will contact you to arrange collection.

Collection will ordinarily occur:

a. at the subscribed venue;

b. at another mutually agreed location; and

c. on a mutually agreed date.

The customer must provide reasonable access to the products.

The parties will act reasonably and cooperate to find a practical collection time.

8. Condition of products

Reasonable wear resulting from ordinary trial use will not by itself prevent a full promotional refund.

You must not intentionally:

a. destroy the products;

b. materially alter them;

c. remove or overwrite their programming;

d. sell or transfer them before collection;

e. conceal them; or

f. prevent Scran from collecting them after electing the full-refund option.

If products are lost, deliberately damaged or unavailable due to the customer’s conduct, Scran may reasonably apply the half-refund option instead, subject to any rights that cannot be excluded by law.

9. Missed collection

If you cannot attend an agreed collection, you should provide reasonable notice where practicable.

If Scran attends an agreed collection and the products are not available, Scran will provide at least one further reasonable opportunity to arrange collection.

If you repeatedly fail to make the NFC products available without reasonable notice or explanation, Scran may:

a. treat the products as retained by you; and

b. apply the half-refund option.

Scran will notify you before doing so and give you a reasonable final opportunity to arrange collection.

10. Half-refund option

You may choose to keep the supplied NFC products.

If you:

a. cancel within the first 30 calendar days; and

b. choose to keep any supplied NFC products,

Scran will refund 50% of the standard subscription fees paid during the first 30 days.

The remaining 50% is retained as the agreed payment for:

a. physical NFC products;

b. customisation;

c. programming;

d. setup and configuration;

e. design and production work; and

f. related fulfilment.

Following the half refund, ownership of the physical NFC products transfers to you.

11. Digital functionality after cancellation

Keeping the physical NFC products does not include permanent access to subscription-based Scran services.

Following cancellation, Scran may deactivate:

a. weekly reporting;

b. analytics;

c. private-feedback features;

d. Scran-hosted landing pages;

e. managed redirects;

f. support services; and

g. other subscription-only digital functionality.

Where practical, Scran may offer to redirect a retained NFC product to a basic destination, but this is not guaranteed unless agreed in writing.

12. Refund calculation examples

Example one: Full refund

A business pays four weekly payments of $15, totalling $60.

It cancels within 30 days, elects the full-refund option and makes all supplied NFC products available for collection.

After Scran collects the products, the promotional refund is:

$60.

Example two: Half refund

A business pays four weekly payments of $15, totalling $60.

It cancels within 30 days and keeps the NFC products.

The promotional refund is:

$30.

Example three: Two payments

A business pays two weekly payments of $15, totalling $30.

It cancels within 30 days and makes all NFC products available for collection.

The full promotional refund is:

$30.

If it keeps the products, the promotional refund is:

$15.

Example four: Cancellation after 30 days

A business cancels more than 30 calendar days after its first successful payment.

The voluntary 30-day guarantee no longer applies.

The subscription will stop in accordance with the normal cancellation provisions, subject to any separate rights available under law.

13. Refund processing time

Approved refunds will be submitted to the original payment method within 10 business days after:

a. Scran approves a half-refund request; or

b. for a full refund, Scran collects all supplied NFC products.

Stripe, the customer’s bank or another financial institution may require additional time to display or release the funds.

Scran is not responsible for delays caused solely by the payment provider or financial institution after Scran has properly submitted the refund.

14. Subscription charges during a guarantee claim

Once Scran receives a valid cancellation request, Scran will take reasonable steps to prevent further recurring subscription charges.

If a payment is processed after a valid cancellation request due solely to processing delay or error, Scran will refund that payment where appropriate.

15. Faulty, damaged or incorrectly supplied products

Contact team@scran.com.au promptly if an NFC product:

a. arrives damaged;

b. is incorrectly programmed;

c. materially differs from what was agreed;

d. does not function properly; or

e. appears defective.

Scran may ask for:

a. photographs;

b. a short video;

c. confirmation of the device used;

d. the location of the product; or

e. other reasonable diagnostic information.

Depending on the circumstances and applicable law, Scran may:

a. reprogram the NFC product;

b. repair it;

c. replace it;

d. collect it;

e. supply the service again;

f. refund the applicable amount; or

g. provide another remedy required by law.

16. Deficient services

If you believe a Scran service was not provided:

a. with due care and skill;

b. within a reasonable period;

c. in accordance with its description; or

d. in a manner fit for an agreed purpose,

contact team@scran.com.au with details of the issue.

Scran will assess the concern and provide a remedy where required.

Depending on the circumstances, this may include:

a. correcting the report;

b. reperforming the service;

c. repairing or updating a link;

d. providing an appropriate credit;

e. cancelling part or all of the service;

f. providing a refund; or

g. another legally required remedy.

17. Change-of-mind cancellations after 30 days

Except where required by law, Scran does not ordinarily provide a refund after the promotional guarantee period merely because:

a. you changed your mind;

b. you stopped using the service;

c. staff failed to display or promote the NFC products;

d. the products received fewer taps than expected;

e. review numbers did not increase;

f. your public rating did not improve;

g. a third-party platform changed its service; or

h. you no longer consider the service useful.

This does not affect remedies available for a fault, misdescription or failure to comply with a statutory guarantee.

18. No guaranteed commercial outcome

Scran does not guarantee:

a. a particular number of reviews;

b. a higher review rating;

c. a particular number of taps or scans;

d. increased revenue;

e. increased customer numbers;

f. improved search visibility; or

g. another specific commercial result.

The 30-day promotional guarantee is governed by the options in this Policy and is not an admission that any particular business outcome was promised.

19. Chargebacks and payment disputes

Customers are encouraged to contact Scran before initiating a payment dispute so Scran can investigate and attempt to resolve the matter.

This does not remove or restrict a customer’s right to contact its bank or payment provider.

Where a chargeback is knowingly false or fraudulent, Scran may suspend the services and take reasonable recovery action permitted by law.

20. Promotional guarantee and statutory rights

The Scran 30-day guarantee is a voluntary promise in addition to rights available under applicable law.

Nothing in this Policy excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded.

A remedy may be available outside the 30-day period where required by the Australian Consumer Law.

21. Changes to this Policy

Scran may update this Policy from time to time.

The current version will be published at:

www.scran.com.au/refunds

A change will not retrospectively remove rights that accrued before the change.

Material changes affecting active customers will be communicated within a reasonable period.
